Wedding Package Includes the following:

Engagement Session: A 1 hour session with bride & groom on any location within 15 miles of Columbia.

40 to 50 images - 4x6 proofs in album included.

Bridal Portrait: A 30 to 45 minute session with bride at any location within 15 miles of Columbia.

20 to 30 digital photos – 4x6 proofs in album included.

Ceremony & Reception: Up to 3 hours of coverage with pre-ceremony photos, pictures of the ceremony,

Wedding party and family sets after ceremony and candid shots during the reception.

100 to 125 digital photos – 4x6 Proofs in Album Included.

Price includes quality proofs suitable for use. No copyright notices, Proof Watermarks or photographer's overlays on prints. All digital images taken will also be provided on a CD Rom with license to duplicate and distribute to friends and family. Additional print packages may be ordered at an additional charge.

Terms and Conditions

This contract is between the bride and groom and/or other contracting party named above, herein after referred to as the Client(s) and Tom Humphries dba Tom Humphries Photography, herein after, referred to as the Photographer and is not binding until signed by all parties.

ENTIRE AGREEMENT:

This agreement contains the entire understanding between Tom Humphries Photography, Photographer and the Client(s) named on page one of this contract. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement; that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

RESERVATION:

A signed contract and reservation fee are required to reserve the specified event date. The reservation fee is calculated at 1/2 of the anticipated charge for photographic services and will be deducted from the amount due for the photographic services under this contract.

PRE-EVENT CONSULTATION:

The parties agree to a pre-event consultation 2 to 3 weeks prior to the event date in order to finalize the actual shooting times, locations, and to obtain a written request list from the Client(s) for specific photographs. The bride and/or groom agree to set aside 30 minutes of time before the ceremony that ends 30 minutes prior to the commencement of the wedding and 30 minutes of time after the ceremony for photographs that cannot be obtained during the wedding. If the bride's or groom's late arrival prevents a full hour from occurring the photographer shall not be held liable for failure to take desired photographs.

COOPERATION OF CLIENTS AND GUESTS:

The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. The Photographer recommends that the Client(s) designate an "event guide" to point out important individuals for informal or candid photographs to the photographer(s) during the wedding and reception that they wish to have photographed. The photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs. The Photographer is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to the Photographer.

SHOOTING TIME / ADDITIONS:

The photography schedule and selected methodology are designed to accomplish the goals and wishes of the Client(s) in a manner that can be enjoyed by all parties. The Client(s) agrees that cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the scheduled start time.

HOUSE RULES:

The photographer is limited by the guidelines established by the ceremony site management and/or the ceremony official performing the ceremony. Like wise the Photographer is limited by the guidelines established by the reception site management. Client(s) agrees to accept the technical results of the guidelines imposed on the photographer. Negotiation with the site management or those officiating over the ceremony to waive or moderate the guidelines is the Client's responsibility; the Photographer will offer technical recommendations only.

COPYRIGHTS:

Until final payment for services rendered is made, the images produced by the Photographer are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without the expressed written consent of the Photographer. Upon final payment by the Client, a limited copyright ownership of the resulting images will be transferred to the Client(s) under the following 2 conditions:

(1) The digital negatives, CD ROM, and any prints purchased are the property of the Client(s) for their unlimited personal use and for the purposes of reproduction and distribution of photographs to friends, relatives or other interested persons including publishing in local newspapers for announcements.

(2) The Client must obtain written permission from and compensate the Photographer prior to the Client(s) or their friends and relatives publishing or selling the photographs for profit.

PHOTOGRAPHER'S USE OF PHOTOGRAPHS:

Unless otherwise specifically agreed herein, The Photographer has the right to use any images, film or digital, and any reproductions for the purpose of creating samples, displaying samples of the Photographers photographic work, entry in photographic exhibitions and other photographic contests, editorial or art displays, general display for the Photographer and advertising, including posting of images on photographer’s web site. The client agrees that they have the permission of all invited guests and attendants to appear in or have photographs taken. No notice of the taking of any photograph is necessary to any guest at this affair. The client hereby assumes all responsibilities and will defend Photographer for claims made in reference to the above, at client’s expense.

MODEL RELEASE:

The Client(s) hereby grants to the Photographer and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client(s) or in which the Client(s) may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases the photographer and its legal representatives and assigns from all claims and liability relating to said photographs.

LIMIT OF LIABILITY:

In the unlikely event that the photographer is injured or becomes too ill to photograph the event, The Photographer will make every effort to secure a replacement photographer. If this situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. The Photographer takes the utmost care with respect to exposure, transportation, and processing of the photographs. However, in the unlikely event that the photographs have been lost, stolen, or destroyed for reasons within or beyond the Photographer's control, the Photographer's liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.

SECURITY DEPOSITS:

In the event of cancellation, the security deposit paid is non-refundable. It shall be considered liquidated damages to the Photographer for the breach of contract by Client(s). The Client(s) shall also be responsible for payment for any photographic materials charges incurred up to time of cancellation. If the Client(s) cancel the event more than 60 days in advance of the date and a replacement event can be booked, then Client(s) obligation is to pay for photographic materials charges incurred up to the time of cancellation and the balance of the deposit will be refunded.

COMPLETION SCHEDULE:

Digital processing and print production can take approximately 3 weeks. Other special order products may take a bit longer. Your images will be transferred to a CD ROM in high resolution JPEG format for your personal use. The images will also be archived in both digital negative (RAW) and JPEG formats by the Photographer for at least 3 months after the completion of your order.

PAYMENT SCHEDULE: 50% due at time of signing of agreement. Balance payable in full 2 weeks before the event.
